Privacy Policy

This policy describes how personal information is processed on this website and when applying for construction work through Workers for Germany, including identity documents and qualifications.

Updated: October 2026. The German privacy policy is the authoritative version; this English translation is provided for clarity.

1. Data controller

Dirk Meßberger, Meßberger Real Estate, Wilhelm-Marx-Str. 9, 90419 Nürnberg, Germany. Phone: +49 171 2751997. Email and privacy inquiries: messberger@gmail.com.

2. General principles

We process personal data only as necessary to operate the website and recruit international construction workers for German companies. Legal bases include Article 6(1)(a), (b), (c), and (f) GDPR; special-category data is handled in accordance with Article 9 GDPR. Data is retained only for its purpose or applicable legal obligations.

3. Website access logs

Our hosting provider processes technical access data such as IP address, access time, requested page, browser and referrer to keep the website secure and operational (Article 6(1)(f) GDPR). Logs are generally deleted within 30 days unless needed to investigate a security incident.

4. Contact

If you contact us by form, email, phone or WhatsApp, we use the information you supply to respond (Article 6(1)(b) or (f) GDPR). We delete it when no longer needed, subject to legal retention duties under German law. WhatsApp Ireland Ltd. may independently process metadata, including transfers outside the EU.

5. Applications and recruitment

We process your name, date of birth, nationality, address, phone, WhatsApp and email, profession, experience, qualifications, language skills, driving licence, mobility, availability, accommodation preferences, salary expectations, optional introduction video and uploaded identity, CV and qualification documents. We use this information to review applications, verify identity and qualifications, communicate with applicants and employers and arrange recruitment.

Legal bases: Article 6(1)(b) GDPR for pre-contractual recruitment, Article 6(1)(a) for consent to share profiles and documents and process optional video, Article 6(1)(c) for legal requirements and Article 6(1)(f) for careful selection and fraud prevention. Providing information is voluntary, but required fields and documents are needed to process an application.

6. Identity documents and sensitive information

Identity documents and certificates require special protection. Uploads use encrypted connections; access is limited to authorized personnel. We do not make identity documents publicly accessible. We share relevant documents with a specific prospective employer after informing the applicant, or with authorities where legally required. Any special-category information, such as health data, requires an applicable Article 9 GDPR basis, including explicit consent when relied upon.

7. Sharing with third parties

We share data only with consent, where necessary for recruitment, under a legal obligation or where legitimate interests are not overridden by yours. Candidate profiles and necessary employment documents are shared with a German employer expressing a specific hiring interest after informing the applicant. The employment contract is between the worker and employer; Workers for Germany is not the employer or a temporary staffing agency.

8. Service providers and international transfers

Selected hosting, storage, email and communications providers assist us under data-processing agreements where required by Article 28 GDPR. Transfers outside the EEA are made only under an adequacy decision or suitable safeguards, including standard contractual clauses under Article 46 GDPR.

9. Retention and deletion

We keep applications while recruiting and for possible subsequent placement. If no placement occurs, data is deleted no later than six months after the selection process, unless the applicant expressly agrees to a longer talent-pool period. If placement occurs, relevant contractual and evidentiary data may be retained under statutory obligations for up to ten years. Identity documents and certificates are deleted when no longer needed unless legal retention applies. You may request earlier deletion.

10. Cookies and local storage

We use only technically necessary cookies or local storage for the operation of the site and forms under § 25(2)(2) TDDDG. We currently do not use tracking, web analytics or advertising cookies.

11. Security

We use encrypted connections, restricted access, software updates, confidentiality commitments with providers and secured storage for sensitive documents to protect against unauthorized access, loss and disclosure.

12. Your rights

Under the GDPR, you may request access, rectification, erasure, restriction and portability of your data, object to certain processing and withdraw consent for the future (Articles 15–21 and 7(3) GDPR). Contact messberger@gmail.com.

13. Complaints

You may complain to a data protection supervisory authority in your country of residence, work or the alleged infringement (Article 77 GDPR). The competent authority for the controller is Bayerisches Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach, Germany; www.lda.bayern.de.

14. Automated decisions

We do not use automated decision-making or profiling within the meaning of Article 22 GDPR. Recruitment decisions are made by people at Workers for Germany and the interested German company.

15. Changes

We update this policy as our processing changes. The current version is always available here. This information does not replace individual legal advice; the German text prevails where translations differ.
